Terms of Service

Stay Fueled LLC

1. Introduction

Welcome to Fuel — a nutrition and wellness tracking application provided by Stay Fueled LLC (“Fuel,” “we,” “our,” or “us”). These Terms of Service (“Terms”) are a legally binding agreement between you (“user,” “you,” or “your”) and Fuel governing your use of the Fuel mobile application, website, and related services (the “App” or “Services”).

By downloading, accessing, or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App. If you use the App on behalf of an organization, you represent you have authority to bind that entity and that you are at least 13 years old and legally able to enter a contract.

2. Purpose and Health Disclaimer

Fuel provides informational tools about nutrition, energy balance, and wellness. It is not medical advice.

  • Not Medical Advice: The App does not diagnose, treat, or provide clinical guidance. Always consult a qualified healthcare professional.
  • No Provider Relationship: Using the App does not create a doctor-patient or therapist-client relationship.
  • Consult a Professional: Speak with a healthcare professional before changing diet, exercise, or medication.
  • Data Accuracy: Data from devices and integrations may have inaccuracies or discrepancies.
  • User Responsibility: You are responsible for how you use the information and accept the risks associated with the App.

3. Payments, Subscriptions, and Refunds

The App is currently free. Paid features may be introduced later with clear pricing and billing terms before purchase.

  • Authorized Payment Method: You must use a valid, authorized payment method and consent to charges via Fuel or app store processors.
  • Billing Terms: Charges may be one-time, in advance, or recurring; review frequency and amounts before purchase.
  • Third-Party Platforms: App store purchases follow that platform’s terms and refund rules.
  • Refunds: Provided as required by law or platform policy; voluntary refunds do not create future obligations.
  • Changes: Paid Services may change; continued use after notice means acceptance.

4. Modifications to Terms or Service

We may update these Terms or modify the App at any time. Continued use after changes are posted is acceptance; if you disagree, stop using the App.

5. Access to the Services

Keep your account and passwords confidential and do not allow others to use your account. You are responsible for all activity on your account and must contact us if it is compromised. We may suspend or terminate access for violations, suspected fraud, or legal reasons. Upon termination, your rights to the App cease and data may be deleted consistent with our Privacy Policy.

6. Electronic Communications

By creating an account, you consent to receive electronic communications, including operational notices, required legal disclosures, and promotional messages. You may opt out of non-essential promotions, but required notices will still be delivered to your provided contact.

7. Use of Service, User Conduct & Prohibited Activities

You agree to use the App lawfully. Do not:

  • Provide false or misleading data or misrepresent your identity.
  • Access other users’ accounts or data without authorization.
  • Reverse engineer, decompile, or attempt to derive source code.
  • Use bots, scrapers, or automated tools to extract data.
  • Upload malware or attempt to disrupt the App or connected systems.
  • Violate laws or third-party rights (including IP, privacy, publicity).
  • Use the App commercially without prior written consent.
  • Interfere with or overload servers, networks, or systems.

We may suspend or terminate access immediately if we believe you violated these Terms.

8. Disclaimer of Warranty and Limitation of Liability

A. General Disclaimer

The App is provided “as is” and “as available” without warranties of any kind, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant uninterrupted or error-free service.

B. Health and Nutrition Disclaimer

The App does not provide medical advice; consult a professional. Data and calculations may vary or contain errors. You assume all risks from use.

C. Limitation of Liability

To the maximum extent allowed by law, Fuel and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use. Total liability is limited to the greater of amounts you paid in the past 12 months or USD $100.

D. Assumption of Risk

You assume risks from data inaccuracies, misinterpretation, and decisions made using the App. This survives termination and applies to you and your successors.

9. Choice of Law, Jurisdiction, and Venue

These Terms are governed by the laws of Ohio, USA, without regard to conflict of law rules. Disputes will be resolved by binding arbitration administered by the American Arbitration Association in Columbus, Ohio. The controlling language is English.

10. Entire Agreement

These Terms, together with our Privacy Policy and any incorporated documents, are the entire agreement between you and Fuel, superseding prior agreements. No third-party beneficiaries are created, and our failure to enforce any provision is not a waiver.

11. Severability

If any provision is invalid or unenforceable, the remaining provisions remain in effect, and a valid term closest to the original intent will replace it where necessary.

12. Release and Covenant Not to Sue

To the maximum extent permitted by law, you release and discharge Fuel and its affiliates from claims or liabilities arising from your use of the App. You agree not to bring claims related to your use and waive protections of laws limiting unknown claim releases to the extent allowed.

13. Indemnification

You agree to defend, indemnify, and hold harmless Fuel and its affiliates from claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms, misuse of the App, or infringement of third-party rights. Fuel may assume defense at your expense; do not settle without our consent.

14. Intellectual Property

All content, software, data, designs, trademarks, and other materials in the App are the property of Fuel or its licensors and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without written permission. All rights not expressly granted are reserved.
